Liability Waiver

I have elected to participate in dance and other athletic performance-related activities on a voluntary basis. I am aware that participation in an Activity presents risks of illness, injury and/or death (including, without limitation, brain injury or other severe bodily harm), and I assume those risks.

I release, waive and discharge Illinois Conservatory for the Arts ("ICA"), its officers, directors, faculty, staff and volunteers, and the facility where I participate in an Activity (the "Location") from any and all liability for injury, death, loss, damage, obligation, expense or penalty, including attorneys' fees, that I may sustain in connection with my participation in an Activity or while traveling to and from the Location, regardless of the cause.

In the event I sustain an illness or injury while at an Activity, or traveling to or from an Activity, I authorize ICA and the Location to obtain medical treatment for me. I understand that this is only an authorization and it does not obligate ICA or the Location to actually obtain medical treatment. I hereby release and hold harmless ICA and the Location in their exercise of, or failure to exercise, this authority. I understand that I will be responsible for all medical and related expenses incurred for my illness or injury.

I consent to ICA: (a) capturing storing and using my image, likeness, voice, and performance through video, photo, and audio recordings taken during Activities, and (b) using these materials, without limitation, for promotional, marketing, advertising, educational, fundraising, or archival purposes in print, online, broadcast, or any other media. I waive all rights of compensation, approval, and ownership of the materials.

ICA is not liable for a failure or delay of any Activity due to causes or circumstances beyond the ICA's reasonable control and without its fault or negligence, including but not limited to accident, illness, Acts of God (including fire, flood, earthquake, storm, hurricane, or other natural disaster), acts of war, acts of government, epidemics, quarantine restrictions, unusually severe weather, terrorist activities, nationalization, labor dispute, strike, lockout, or interruption or failure of utility service. Despite such an occurrence, ICA will undertake commercially reasonable efforts to modify, carry on or postpone the affected Activity so that it may proceed in a modified form or at a different time or place. ICA shall have no obligation to pay a refund for an Activity affected by such an occurrence.

I understand that ICA undertakes significant planning, preparation, reservations, hiring and arranging numerous third-party services in reliance on Activity enrollments, such as mine. As such, if I unable to attend or participate in the Activity, I will not receive a refund and am still responsible for any balance owed.

This Participant Liability Waiver, and all other agreements I have with ICA, shall be governed by and construed in accordance with the laws of the State of Illinois without regard to its conflict of laws provisions. For any litigation related to an Activity or this Waiver or any other agreement I have with ICA, I consent to the exclusive jurisdiction of any state or federal court located within the State of Illinois that has jurisdiction of ICA's principal place of business. I waive any defense of forum non conveniens, and I WAIVE TRIAL BY JURY in any such litigation.
